Stay in Control: Avoiding Guardianship
with Smart Planning
This presentation will provide an overview of guardianship proceedings in New York. It will focus
on practical strategies to avoid guardianship through proper planning, emphasizing the
importance of comprehensive advance directives. Attendees will gain a clear understanding of
key documents such as the Health Care Proxy and Power of Attorney, and how these tools can
preserve autonomy and streamline decision-making. The program is designed to equip
individuals with the knowledge needed to proactively protect themselves and their loved ones.
Guest Speaker: Julia L. Santo is a member of Abrams Fensterman, LLP’s Elder Law and Estate Planning Group. Her practice focuses on Medicaid planning, crafting estate plans, estate administration and probate proceedings, and guardianship. Julia is admitted to practice law in the State of New York and is an active member of the Nassau County Bar Association and New York State Bar Association. Julia was selected as a “Rising Star” in New York Elder Law by “Super Lawyers” in 2024 and 2025. In her spare time, she enjoys reading, and spending time together with her husband, Ben, daughter, Eloise, their dog, Harry, and two cats, Franklin and Ella.
